RESOLUTION 2010-02    ESTABLISHING A STORM WATER UTILITY FUND FOR THE VILLAGE OF MANCHESTER

WHEREAS, ORC 5705.12 PERMITS Villages to establish funds wherein money derived from specific sources other than general property tax shall be paid directly into such funds.

BE IT RESOLVED, by the Council of the Vilage of Manchester, Adams County, Ohio, two thirds (2/3rds) or more of all members concurring as follows:

Section 1: The Fiscal Officer shall establish a Stor Water Utility Fund.

Section 2: The Fiscal Oficer shall coonsult with the Auditor of State (via the Financial Planning and Supervision Commission for Manchhester) regarding approval of this fund.

Section 3: The sources of said fund shall be a line item on the water bill with monthly deposits into the fund as follows: $2.00 (two dollars) per water tap.

Section 4: Said funds will be used for the repair and construction of storm water infrastructure.

Section 5: The fund shall begin collection the next water water billing cycle after approval of this resolution and approval by the auditor.

This resolution is hereby declared to be an emergency measure to expedite repairing storm sewers that are a safety hazard. Following appropriate legislative action it shall take effect and be in force after the earliest period allowed by law.
